Who grants the exemption permit?
The supreme state authorities are competent. In their place, the bodies designated by them or competent under state law can decide.
Exemptions can be approved from the rules of chapters 1 to 5 of the ordinance.
Which kinds of exemptions exist?
- exemptions in specific individual cases,
- general exemptions for specific individual applicants.
The ordinance knows only these 2 kinds.
From what is there no exemption?
| Rule | Subject |
|---|---|
| § 9 paragraph 2 | interchangeable plates |
| § 11 paragraph 1 | marking of electrically powered vehicles |
| § 14 paragraphs 1 and 3 | registration certificate part II |
| Chapter 3 sub-chapter 5 | part of the rules on internet-based registration |
Exemptions may not extend to these rules.
Where does the permit apply?
Every permit defines its territorial scope.
If the exemption has considerable effects on the territory of other states, the decision is taken in agreement with their competent authorities.
Must the permit be carried?
Yes, if an exemption in an individual case is issued with conditions or combined with requirements. The person driving the vehicle then carries the permit on journeys and hands it to competent persons on request.
To whom does the ordinance not apply?
The rules do not apply to the armed forces, police, federal police, fire service, Federal Agency for Technical Relief, civil protection and disaster control, and customs administration. This applies only as far as needed to perform sovereign tasks.
What does this mean for dealers?
For ordinary trade the ordinance remains the yardstick; exemptions are individual decisions of the states.
